Hoppy Refresher Giveaway

1. Sponsor: The Lagunitas Brewing Co., 1280 N. McDowell Blvd. Petaluma, CA 94954. 
2. Eligibility: The Lagunitas Hoppy Refresher Sweepstakes (the “Promotion”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are 21 years of age or older at the time of entry (“Entrant”). Void whereprohibited or restricted by law. Employees of The Lagunitas Brewing Company (“Sponsor”), its advertising and promotional agencies involved in the promotion, state alcohol beverage commissions, alcoholic beverage manufacturers, distributors, and retailers, and their respective parent companies, subsidiaries, and affiliates, and their immediate family members (spouse, parent, sibling, and children) or members of the same household of any of the foregoing are not eligible to participate. All applicable federal, state, and local laws and regulations apply. 
3. Agreement To Official Rules: Participation in this Promotion constitutes your full and unconditional agreement to these Official Rules and Sponsor’s decisions. These decisions are final and binding in all matters related to this Promotion. Receipt of a prize is contingent upon fulfilling all applicable requirements set forth herein. 
4. Timing: The Promotion will begin on January 7, 2026, at approximately 12:00 PM Pacific Standard Time (“EST”) and will end on January 19, 2026 (the “Promotion Period”) at 11:59 PM PST). Sponsor’s computer is the official clock for the Promotion. 
5. How to Enter: To enter the Promotion, entrant (“Entrant” or “You”) must be a registered member of Instagram.STEP 1: Log into your Instagram account via a web-enabled mobile device (if you are not already a member of Instagram, download and install the free Instagram mobile application on your web-enabled mobile device and register for a free Instagram account). Your Account must be a Public Account.

    STEP 2: Sponsor will post the Post on or about January 7, 2026, at approximately 12:00 PM PST on the @lagunitasbeer Instagram page. 

   STEP 3: During the Promotion Period, Entrant must (1) “like” the Post, (2) follow @lagunitasbeer on Instagram, and (3) comment on the Post with a water emoji.   Only one (1) entry per Instagram account. 

   An entrant can enter the Promotion only once during the Promotion Period. Multiple entries by the same person will not be counted. Sponsor is not responsible for lost, late, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected entries, all of which will be void. In the event of a dispute over the identity of any potential winner, the entry will be declared made by the authorized account holder of the account used for entry, and potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder.  

   Entrants must notify Sponsor of any changed contact information within the Entry Period to remain eligible to win based on an Entry.  Any eligibility disputes will be determined by Sponsor in its sole discretion. 

   Sponsor reserves the right, in its sole discretion, to disqualify any individual or entity found to be tampering with the Entry process or the operation of the Promotion; to be acting in violation of these Official Rules or applicable laws; or to be acting with intent to annoy, abuse, threaten or harass any third party.  Any use of robotic, automatic, programmed or similar entry methods is prohibited, and any such Entries will be disqualified and void. 

   This Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram. Instagram is hereby completely released of all liability by each participant in this Promotion.  Any questions, comments or complaints regarding this Promotion must be directed to Sponsor and not to Instagram. 

6. Prizes: One (1) winner will receive the following prizes:
   – Twelve (12) cases of Lagunitas Hoppy Refresher Original (twenty-four (24) twelve-ounce (12 oz) cans) with an ARV of $39.96 each. The total ARV of the prize package is $[479.52]. 

   Odds of winning a prize depend on the number of eligible entries received during the applicable Promotion Entry Period. Alcoholic beverages are not part of the prize. PRIZES ARE AWARDED “AS IS” WITH NO WARRANTY OR GUARANTEE, EITHER EXPRESS OR IMPLIED. Only one (1) prize package per winning Instagram account. Prizes cannot be transferred, redeemed for cash, or substituted by the winner. Sponsor reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if a prize described in these Official Rules is unavailable or cannot be awarded, in whole or in part, for any reason. The ARV of the prize represents Sponsor’s good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated ARV, the difference will not be awarded in cash. Restrictions, conditions, and limitations may apply. 

7. Drawing: Sponsor’s selection of the Winner is final and binding in all matters related to the Promotion.  Sponsor will randomly select the potential Winner from all eligible entries received during the Promotion Period on or about January 20, 2026. The Winner will be notified by direct message from @lagunitasbeer on Instagram on or about January 26, 2026. @lagunitasbeer will request that the Winner send a reply direct message to @lagunitasbeer on Instagram with their e-mail address within three (3) days of Winner notification. Sponsor shall have no liability for a Winner’s failure to receive notices due to Winner’s spam, junk e-mail, notifications, or other security settings on Winner’s Instagram account or for Winner’s provision of incorrect or otherwise non-functioning contact information.  

   The potential Winner may be required to complete, sign, and return an Affidavit of Eligibility and Liability Release and, where legal, a Publicity Release (collectively the “Affidavit”) and an IRS Form W-9. The potential Winner may be required to furnishhis/her social security number that will be used only for the purpose of reporting the Winner’s prize earnings to the Internal Revenue Service, as required by law.  Completed documents must be returned within five (5) calendar days from prize notification date or the prize will be forfeited and awarded to an alternate potential winner. If a potential Winner (i) cannot be contacted after a reasonable attempt has been made by Sponsor (as determined in Sponsor’s sole discretion); (ii) fails to timely return the required paperwork without alteration and in the form presented by Sponsor; (iii) refuses the prize; and/or (iv) the prize or prize notification is rejected or returned as undeliverable, then such potential Winner forfeits all rights to be deemed a winner in the Sweepstakes and receive the prize, and will be disqualified and an alternate potential Winner will be determined based on the next entry selected at random. Prize must be accepted as awarded. Prize is not assignable and not transferable. Sponsor will not replace any lost or stolen prize items.

    

8. Publicity: Acceptance of any prize shall constitute and signify each winner’s agreement and consent that Sponsor and its designees may use the Winner’s name, likeness, photo, entry submission, and/or prize information in connection with the Promotion for promotional, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law. Sponsor and its designees shall have the right to edit, exploit, adapt, distribute, post, and create derivative works of, in whole or in part, and in combination with other materials, in any manner, for any advertising, promotional, trade, commercial or other purposes in any and all media, now or hereafter devised, worldwide, in perpetuity, and without further payment or consideration, notification or permission. 
9. Release: By participating in the Promotion and/or accepting a prize, the Entrant agrees to release and hold harmless Sponsor, its subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers/partners, its parent companies and company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of a prize. Entrant hereby agrees to indemnify and hold Sponsor harmless from and against any third-party claims, actions or proceedings of any kind and from any, and all damages, liabilities, costs and expenses, including attorney fees and court costs, arising out of any breach or alleged breach of any of the warranties and representations set forth herein. Entrant further understands and agrees that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. Entrant acknowledges that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY
   
10. General Conditions: By participating, Entrants agree to be bound by these Official Rules and the decisions of Sponsor. If, for any reason, the Promotion is not capable of running as planned, Sponsor reserves the right, in its sole and absolute discretion (a) to cancel, terminate, modify or suspend the Promotion, including not selecting a winner; and/or (b) proceed with the Promotion, including selecting a winner in a manner it deems fair and reasonable, including from among eligible, non-suspect entries received prior to such cancellation, termination, modification or suspension. Sponsor will not be responsible for any prize cancellations, delays, diversions or substitutions or any other causes beyond its reasonable control, including by any event organizer or any other persons providing any goods or services related to the prize. No refund or compensation will be made in the event of the cancellation, delay, or substitution of any prize beyond the reasonable control of Sponsor, except in the sole discretion of Sponsor.  Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the Entry process or the operation of the Promotion or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner and void all associated Entries.  Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek any and all remedies available from any such person to the fullest extent permitted by law.  Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
    
11. Limitations of Liability: Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Entry process or the Promotion; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of the Promotion, the uploading, the processing or judging of Entries, the announcement of the prizes or in any Promotion-related materials; (5) late, lost, undeliverable, damaged entries; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Promotion or receipt or use or misuse of any prize (including any travel/activity related thereto).  Released Parties are not responsible for misdirected or undeliverable entries or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof.  Released Parties are not responsible for any unauthorized third party use of any Entry submission.
    
12. Governing Law: This Promotion is subject to all applicable federal, state, and local laws. This Promotion and Official Rules are governed and interpreted by the laws of the State of California, USA without regard to its conflict of law provisions. 
13. Entrant’s Personal Information: Information collected from Entrants is subject to Sponsor’s Terms of Use and Privacy Policy available at: https://lagunitas.com/legal and https://lagunitas.com/privacy, respectively. Each Entrant expressly agrees tothe use of his/her personal information for such purpose. The Released Parties will not sell, share or otherwise disclose information collected in any manner with third parties, other than those parties necessary to fulfill the above purposes, unless Entrant has given his prior express consent to receive additional information from the Released Parties or a third party. 
14. Winner’s List: For the Winner List, please send an e-mail to brand@lagunitas.com with “Hoppy Refresher Giveaway” in the subject along with the date of the relevant Promotion Entry Period.  Requests for the names of winners must be received no later than February 15, 2026.
